Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the CCSM (Cleaning & Consumable Supplies Melbourne) website ("the Site") and your purchase of goods from us. By accessing the Site or placing an order, you agree to be bound by these Terms.

1. Agreement

1.1 In these Terms, "CCSM", "we", "us", and "our" refer to Cleaning & Consumable Supplies Melbourne (CCSM), ABN 33 620 610 568, located at 39/830-850 Princes Highway, Springvale VIC 3171. "You" refers to the person or business placing an order or using the Site.

1.2 These Terms apply to all transactions between us and you. If you place an order on behalf of a business, you confirm that you have authority to bind that business to these Terms.

1.3 We may display additional terms for specific products, services, or promotions. Where additional terms apply, they form part of the agreement between us.

2. Orders and acceptance

2.1 Your placement of an order through the Site or by any other means ("Order") constitutes an offer by you to purchase goods on these Terms.

2.2 An Order is accepted by us only when we issue an order confirmation, dispatch the goods, or otherwise notify you of acceptance. Any automatic acknowledgement of receipt is not an acceptance.

2.3 We reserve the right to refuse or cancel any Order at our discretion, including where:

• The product is out of stock or unavailable.
• There has been an error in pricing or product information.
• We suspect fraud or misuse.
• The Order does not comply with our supply policies.

2.4 Where a product is unavailable, we may, with your consent, supply a comparable substitute at a similar price.

3. Pricing and GST

3.1 Prices on our Site are displayed in Australian Dollars (AUD).

3.2 Prices displayed are retail prices. Approved business and wholesale account holders, when logged in, will see their account-specific pricing.

3.3 All prices are subject to Goods and Services Tax (GST) at 10%, unless the goods are GST-exempt under Australian taxation law.

3.4 Prices do not include delivery charges or any administrative surcharges, which will be calculated and displayed at checkout.

3.5 We reserve the right to change prices at any time without notice. The price applicable to your Order is the price displayed at the time you place the Order.

3.6 While we make every effort to ensure pricing accuracy, errors may occur. If we identify a pricing error after you place an Order, we will contact you with the correct price and you may choose to proceed or cancel.

4. Payment terms

4.1 Payment is accepted via the payment methods displayed at checkout.

4.2 For approved business accounts, payment terms are as agreed in writing at the time the account is opened.

4.3 If any portion of an invoice is disputed, you must:

• Pay the undisputed portion in accordance with the agreed payment terms;
• Notify us in writing of the disputed portion within 14 days of the dispute arising, including full particulars.

4.4 We reserve the right to suspend further deliveries or place an account on hold if payment terms are not met.

4.5 Overdue accounts may be charged interest at the Reserve Bank of Australia cash rate plus 2% per annum, calculated daily on the outstanding balance.

4.6 All costs incurred by us in recovering overdue amounts, including debt collection fees, legal costs, and disbursements, are payable by you.

5. Delivery

5.1 We deliver across Melbourne and surrounding areas, up to approximately 120 km by road from our Springvale depot. Goods will be delivered to the address specified in your Order.

5.2 Delivery fees are calculated from the delivery address and shown at checkout before you place your Order. Standard delivery is free on Orders of $300 or more (before GST) for addresses within 40 minutes' drive of our Springvale depot, and on Orders of $1,000 or more (before GST) for addresses 41 to 60 minutes' drive away. Free delivery does not apply to Express delivery, or to addresses more than 60 minutes' drive away.

5.3 Delivery times are estimates only. We are not liable for delays caused by carriers, customs, weather, or other circumstances beyond our control.

5.4 You must ensure that someone is available at the delivery address to receive and inspect the goods. If we are unable to deliver due to no person being present, you may be charged for re-delivery, storage, or return freight.

5.5 Please inspect goods on delivery and notify us of any visible damage, shortage, or incorrect items within 48 hours of delivery. This does not limit your rights under the Australian Consumer Law.

6. Title and risk

6.1 Risk in the goods passes to you on delivery to the address specified in your Order.

6.2 Title (ownership) in the goods does not pass to you until we have received payment in full for those goods.

6.3 Until title passes, you hold the goods as bailee for us and must store them separately and identifiably as our property. We may register a security interest under the Personal Property Securities Act 2009 (Cth) and may recover unpaid goods.

7. Returns and refunds

7.1 Your rights to a refund, replacement, or repair under the Australian Consumer Law are not affected by these Terms. The goods come with guarantees that cannot be excluded under the Australian Consumer Law.

7.2 Outside of Australian Consumer Law rights, we accept change-of-mind returns only where:

• The goods reach us within 7 days of the purchase date;
• The goods are unused, unopened, in their original sealed packaging, and in resaleable condition;
• You provide proof of purchase.

7.3 A 20% restocking fee applies to change-of-mind returns and is deducted from the refund. Change-of-mind returns must be dropped off at our Springvale depot during business hours. Where goods are faulty, damaged on arrival, or incorrect, we will collect them at no cost to you.

7.4 Custom orders, special-order items, opened or partially used chemical products, and opened hygiene products cannot be returned except where required by Australian Consumer Law.

7.5 Refunds, where applicable, will be processed using the original payment method within 14 days of receipt of returned goods.

8. Chemical products and safety

8.1 Many of our products are industrial cleaning chemicals. By purchasing chemical products from us, you acknowledge and agree that:

• You will read and follow the Safety Data Sheet (SDS) and product label for each product before use.
• You will use the products only for their intended purpose, in accordance with the manufacturer's instructions.
• You are responsible for ensuring that anyone using the products on your behalf is appropriately trained and equipped (including personal protective equipment).
• You will store, handle, and dispose of products in accordance with applicable laws and regulations, including workplace health and safety obligations.

8.2 Safety Data Sheets are available on request. Please contact us for the SDS for any product before first use.

8.3 We are not liable for any injury, damage, or loss arising from misuse, improper handling, improper storage, or use of the products contrary to the SDS or product instructions.

9. Warranties and consumer guarantees

9.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

9.2 Beyond the consumer guarantees provided by the Australian Consumer Law, we make no other warranties or representations, express or implied, including warranties of merchantability or fitness for any particular purpose.

10. Limitation of liability

10.1 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded, restricted, or modified under the Australian Consumer Law or any other applicable law.

10.2 Subject to clause 10.1, our total liability to you for any claim arising out of or in connection with these Terms or the goods is limited, at our option, to:

• Replacement of the goods;
• Repair of the goods;
• Refund of the price paid for the goods.

10.3 Subject to clause 10.1, we are not liable for any indirect, consequential, special, or incidental loss or damage, including loss of profit, loss of business, loss of revenue, or loss of opportunity.

11. Website use

11.1 You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site.

11.2 We make every effort to ensure the accuracy of information on the Site, but we do not warrant that the Site is free from errors, omissions, or interruptions. We may update or change the Site at any time without notice.

11.3 We are not liable for any loss or damage arising from your use of, or inability to use, the Site.

12. Intellectual property

12.1 All content on the Site, including text, images, logos, graphics, product descriptions, and design, is owned by or licensed to CCSM and is protected by Australian and international copyright and trade mark laws.

12.2 You may view, print, and download content from the Site for personal or internal business use. You may not reproduce, modify, distribute, or commercially exploit any content without our prior written consent.

13. Privacy

Your privacy is important to us. Our handling of your personal information is governed by our Privacy Policy, which forms part of these Terms.

14. Force majeure

We are not liable for any failure to perform our obligations under these Terms where the failure is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, supply chain disruptions, strikes, or carrier delays.

15. Governing law and jurisdiction

15.1 These Terms are governed by the laws of Victoria, Australia.

15.2 You and we submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia in respect of any dispute arising out of or in connection with these Terms.

16. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were last revised. The Terms applicable to your Order are those displayed at the time you place the Order. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
